select rect says drag a rectangle but scene rotates instead

When using the selection tool, right click will pause the tool and enable rotation (if you are in orbit or pivot nav mode, not WASD) -- Click resume to re-enable the selection tool.

Hi,
I am in ortho view, though no indicator says ortho, I am using the select option lower right, left one says rect, and says click for the top left of a rectangle, I do so and immediately get a green dot appear and the scene rotates and becomes non ortho.
I try again resetting with 9 as top and 5 as ortho (as set up to match Agisoft for my sanity) and same happens.,
happens whether I am in ortho or not.
the selection rect option rotates the scene instead.
